The Center for the Fight against Impunity and Injustice in Rwanda (CLIIR) has just learned that a large Rwandan delegation is in Malawi to negotiate the signing of an Intergovernmental Agreement on the exchange of persons prosecuted by two countries (guhererekanya abaregwa ibyaha).

Indeed, this Rwandan delegation is especially charged with obtaining the extradition of the persons accused by the Rwandan regime.

In fact, the Kigali regime is seeking the right to deport Hutu refugees who survived the massacres committed by Rwandan soldiers in the Democratic Republic of the Congo. These refugees now feel threatened by the signing of this agreement.

Chronology of the facts:

In mid-December 2016, a former Hutu refugee who became a merchant and a Malawian citizen, Mr. Vincent MUREKEZI, was arrested and imprisoned in Lilongwe, capital of Malawi, following genocide charges brought against him by the Rwandan government.

After his arrest, other traders, in connection with the Rwandan government, also accused him of having diverted the taxes due to the Malawi tax authorities. The Rwandan government demanded his extradition for trial in Rwanda, where the magistrates are terrorized and under the sole head of state, Rwandan President Paul KAGAME

Tuesday, February 14, 2017, Mr. Vincent MUREKEZI was acquitted of the crime of genocide by the arguments of his defense. These are: First, Mr. Vincent Murekezi was in possession of a Rwandan passport that he had obtained at the time he was working for the Rwandan authorities. The Rwandan authorities had instructed him to destabilize the other Rwandan refugees targeted by the Rwandan government and to organize the Rwandan diaspora in that country.

Moreover, several refugees feeling threatened have fled Malawi because of Murekezi. Secondly, there is no extradition agreement between the two countries. When the Rwandan authorities learned that he would be acquitted, they rushed to Malawi and proposed an extradition agreement.

Only Rwanda is interested in such an agreement because there would not be citizens of Malawi in Rwanda, according to our information.

From Monday, February 13 to Tuesday, February 14, 2017, Ambassador of Rwanda for both countries: Zambia and Malawi (headquartered in Zambia), Ms. Monique MUKARURIZA was in the Crossroads Hotel in Lilongwe to prepare, The mission of a delegation led by the Minister of Foreign Affairs of Rwanda, Louise MUSHIKIWABO, whose date of arrival in Malawi is unknown. The Rwandan refugee community, very concerned, tried to follow this event.

On Thursday February 16, 2017, Malawi Television announced that talks are taking place between the authorities of Malawi and a Rwandan delegation led by Minister Louise Mushikiwabo.

The negotiations will continue on Monday, February 20, 2017. Knowing the Rwandan government’s manipulation and corruption capabilities, Rwandan refugees are deeply concerned about the extradition agreement, which aims to destabilize them in order to better ransom them as it is the case in Mozambique.

 Background: All Hutu refugees are targeted around the world.

The Rwandan government has never stopped pursuing the surviving Hutu refugees in the host countries. In recent times, Rwandan delegations have been sent to several African countries, notably in Mozambique, Congo Brazzaville, Uganda, etc.

The main objective of the Rwandan regime is to control ransom and terrorize these refugees by deporting some of them who have managed to financial settle themselves in these host countries. Indeed, some have managed to become traders, professors or national and / or international civil servants, while others have found work that allows them to be free from the basic need.

In Rwanda all of those hutu refugees that has been deported and who have the financial means are under the strong pressure of Rwanda to give money to the numerous mafia funds created in Rwanda and whose management methods are unknown: the Agaciro Fund, the Ishema Fund, The forced contributions of the Rwandan Patriotic Front (RPF), a party that monopolizes power, etc.

In addition, these refugees are under pressure to enlist in the “Rwandan Diaspora” to better control, terrorize and extract money from them that is sent to Rwanda. These refugees, who have become “dairy cows”, are at the mercy of the Rwandan regime when extradition agreements are signed with the countries hosting these refugees.

Rwanda’s warrants of arrest and judicial records are not credible, as they are made by the Directorate of Military Intelligence, which is responsible for organizing the “Hunt for Intellectuals” (See the testimony of Lieutenant Abdul RUZIBIZA in the appendix).

Recommendations: The CLIIR urges:

  1. That the Government of Malawi refuses to sign any agreement to deport Rwandan refugees to Rwanda, where there is no fair and equitable justice;

2. That the Government of Rwanda ceases hunting for Hutu refugees and especially the “hunt for the Hutu intelligentsia” made up of intellectuals and traders;

3. That the Rwandan refugee communities in each host country set up Associations of Rwandan exiles capable of representing them and negotiate with the authorities of these host countries to defend themselves against a killing regime of Kigali.

The massacres of Hutu refugees in Kibeho (south central Rwanda) in April 1995 and the massacres of Hutu refugees in the Democratic Republic of Congo (DRC) between 1996 and 2003 are evidence of ethnic persecution directed against Hutu survivors of crimes of genocide committed in Rwanda and in countries bordering Rwanda.

In his book of 494 pages, published in October 2005 by Panorama and titled “Rwanda: Secret History”, pages 262-263: This Tutsi soldier of the Rwandan Patriotic Front (RPF) army recognizes that his army led the hunting of intellectuals and the Hutu intelligentsia in the city of Kigali from April 13th , 1994

“Since then, the units have shared tasks in Kigali.

The 3rd battalion, the most experienced in the city, was given the task of protecting the political leaders of the RPF, to supply ammunition to the 59th mobile, 101 ‘and mobile Alpha.

The other important task was to rescue the political leaders still alive in the opposing camp as the RPF was planning to use after the seizure of power. Apart from certain persons who were to be rescued in order to use them later, no official plan to rescue Tutsis was put in place.

The 3rd Battalion was aware of the massacre of the Tutsis at the ETO (Official Technical School of Kicukiro) which was not far away but never intervened.

Identical massacres took place at the Christus Center in Remera, nothing was done to stop them. Even worse, in Kimihurura, there was no intervention to save the Tutsis massacred in the center of the Salesian Brothers, very close to the positions of the soldiers of the 3rd Battalion of the Rwandan Patriotic Army.

The other task, carried out by the 3rd Battalion, the DMI and the extremists of the RPF, was the selection and kidnapping of Hutus wherever they were taken by the APR in Kigali City.

They were rounded up to be liquidated afterwards. This task was accomplished by people who knew the city of Kigali well and by the politicians protected by the RPF. It is Captain Charles KARAMBA, Captain Jean Damascène SEKAMANA, Sergeant Déus KAGIRANEZA and the other intelligence agents who established lists of Hutus to be killed on the pretext that they were educated or had influential families.

This task was easy because they took information from the Tutsi refugee families at the CND or the Amahoro stadium in Remera.

Among these civilians in charge of giving information we can mention GATETE Polycarpe, Paul MUVUNYI, Jean Marie MUNYANKINDI, Théoneste MUTSINDASHYAKA and especially Tito RUTAREMARA, who had lived in Kigali for some time, and there were many others.

The top leaders, such as Tito RUTAREMARA, who did not know a lot of politicians in the city of Kigali asked for information from those who knew the city, such as Deus KAGIRANEZA, to designate those who were to be killed.

I will cite for example the case of Emmanuel BAHIGIKI who had been secretary general of the Ministry of Planning and headed the IWACU Center.

The reason for his assassination was that he had a list of at least one hundred people murdered by the Rwandan Patriotic Army (APR) in the buffer zone for refusing to follow the ideology of the RPF (Patriotic Front Rwandans), as well as local leaders elected by the population who refused allegiance to the RPF. His assassination was commissioned by Captain Charles KARAMBA “.
